Claims – acknowledgement, faults and shortcomings

Responsibilities and terms and conditions
When you receive your goods, you must react as follows:
• Check the goods and the condition of the packaging.
• Count the amount of items so that it agrees with the consignment note.
• Sign the consignment note if everything is correct.

If the goods are damaged or the quantity does not tally, you must react as follows:
• Receive the goods.
• Make a comment (reservation) on the consignment note. See below.
• Inform NTEX if there are goods missing.
• Submit a claim for damages immediately by e-mail, letter or fax. See below.
• Limit the damage if it is possible.
• Your consignment note is a valuable document!

Reservation:
With a reservation on the consignment note, you are showing that the goods are damaged or something was wrong when you received them. NTEX is then given the chance to track down the reason and prevent it happening again.

Claims/complaints:
If the goods have been damaged or there is something wrong that has been hidden by the packaging and was not discovered until the goods were unpackaged – you must submit a claim for the damage in writing within seven working days after you first received the goods. When you register your complaint within this time period, the damage is regarded as being caused during transport – unless NTEX can prove the opposite. If you however submit a claim after 7 working days, the onus is on you to prove that the damage arose during transport. The final amount of time allowed for complaints runs out one year after receipt of the goods.

NTEX would like to be able to inspect the damage. Therefore, please do not return, sell or repair the damaged goods. You must keep both the goods and the packaging in safe keeping.

You must produce the compensation claim yourself and substantiate the size of the claim.

You should include the following documents:
• Consignment note/CMR.
• Your commercial invoice from the company that sold you the goods or other documentation which substantiates the value of the goods.
• Invoices if the goods as per agreement with NTEX have been repaired or replaced.
• Other documentation in order to regulate the damage correctly, for example photographs.

NTEX will investigate the damage in accordance with NSAB 2000 (for instance the CMR-convention note and VTL [the Swedish Domestic Road Transport Act]), then we will contact you.

If you have merchandise insurance, you should report the damage to your insurance company to speed up the claims process. That is why NTEX always recommends that you are insured.
